Reader’s Question:

My friend is seventeen years old from New Jersey. She is using her fathers car and is covered under her father’s car insurance. Her father died and now live with her twenty year old sister. My friend does not have a drivers license and do not know how to drive. Basically we would like to know if my friend can own the car and get car insurance for it. If not can her sister insure the car since she is older.

In New Jersey a seventeen year old or her twenty year old sister can own a car and get car insurance for it. In New Jersey one must be at least seventeen years old to have the car registered. According to the New Jersey Motor Vehicle Commission a car registered in the name of a decedent may be driven for thirty days after the death by an immediate family member or any licensed motorist who has permission from the surviving family member.

The New Jersey Motor Vehicle Commission has guidelines for how to transfer the title if the car is left in the will, to an estate or without a will. To be able to properly title the vehicle it is important that your friend contact the New Jersey Motor Vehicle Commission for specifics. It is best to discuss this with the father’s auto insurance provider to determine what it will take to change the policy.
